Terms of Service

These terms govern your use of the Sociable website and service. They sit alongside the Founding Member Agreement, which is the document that actually creates the protection plan and the Remedy.

These Terms of Service govern your use of the Sociable website, member console, and related services, operated by Sociably Safe, Inc., doing business as Sociable. By using any of it you agree to these terms.

If you have bought a protection plan, the Founding Member Agreement also applies, and where the two disagree about the plan itself, that document wins.

1. Eligibility

You need to be at least 18 and able to enter a binding contract. If you are using Sociable for an organization, you are telling us you have the authority to bind it.

2. Your Sociable account

You are responsible for keeping your Sociable credentials confidential and for what happens under your account. Tell us at james@get-sociable.com if you think someone has got into it.

We require multi-factor authentication on your Sociable account. Multi-factor authentication on your connected social accounts is a condition of Remedy eligibility under the member agreement.

3. Connecting your social accounts

Sociable works by connecting to your social media accounts through each platform’s own authorization process. When you connect one, you are authorizing us to access the data that platform makes available, for the purposes set out in the Privacy Policy.

We never ask for, receive, or store your social media passwords.

You can disconnect any account at any time from your member console. Disconnecting stops monitoring for that account immediately and, under the member agreement, pauses Remedy eligibility for it.

Your use of each platform is still governed by that platform’s own terms. Sociable is not affiliated with, endorsed by, or sponsored by any social media platform.

4. Acceptable use

You agree not to:

• Connect an account you do not own or are not authorized to control
• Use Sociable to monitor someone else’s account without their authorization
• Interfere with, disrupt, probe, or try to get unauthorized access to the service
• Reverse engineer or scrape the service, or use it to build a competing product
• Give us false information about an incident

We can suspend or end access for breaking this section. Where we do, we will refund the unused part of your year, unless the breach involved a false incident report.

5. What Sociable is, and is not

Sociable is a protection plan. It is a warranty and service agreement. It is not an insurance policy and you are not an insured.

Cysurance, LLC is the obligor. Cysurance owes you the Remedy and pays it, and your rights to the Remedy run against Cysurance. Cysurance issues its warranty to you when your protection activates, and that warranty form is part of your Founding Member Agreement. The warranty is backed by Cysurance insurance programs and fully reinsured, so the money is there before you need it.

Sociably Safe, Inc., trading as Sociable, is the program’s distributor and service provider. We sell the program, we monitor your accounts, and we work to recover any account that is taken. We are not the obligor and we do not pay the Remedy.

The identity protection included with paid plans is provided by Cysurance. The helpline and servicing run through TransUnion, and CyberScout, a TransUnion company, handles remediation, funds recovery, and identity restoration, under their own terms.

6. Fees

Plan fees are shown at checkout and charged by Sociable once a year in advance. Stripe processes payment and we never store your card details. Fees do not include taxes, which we will add where we have to.

Your refund rights are in the Founding Member Agreement.

7. Availability and platform dependence

We aim to keep Sociable running continuously but we do not guarantee uninterrupted availability.

Monitoring depends on social media platform interfaces that the platforms control and can change or withdraw without telling us. If a platform materially restricts or removes the access we depend on, we will tell you. If we can no longer monitor a platform you rely on, you may cancel and we will refund the unused part of your year.

8. Intellectual property

Sociable, including its software, design, text, and marks, belongs to us and is protected by intellectual property law. We give you a limited, revocable, non-exclusive, non-transferable licence to use it for what it is for.

You keep every right in your own content and your own accounts. You give us only the permissions we need to do the job, as described in the Privacy Policy.

9. Disclaimers

Except for what the Founding Member Agreement expressly promises, the service is provided as is and as available. To the fullest extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We cannot promise that we will catch every compromise, that we will recover any account, or that a platform will respond to us at all. What is certain is the Remedy, which Cysurance owes you under the Founding Member Agreement.

10. Limitation of liability

To the fullest extent the law allows, Sociable’s total liability arising out of or relating to the service is limited to the fees you paid us in the previous twelve months. Nothing in this section affects what Cysurance owes you under the Founding Member Agreement. Neither of us is liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, data, or goodwill.

Nothing here limits liability that cannot be limited by law.

11. Changes

We may update these terms. We will post the new version with a new effective date, and for material changes we will email members at least 30 days beforehand.

12. Termination

You can stop using Sociable whenever you like. We can suspend or end access for a material breach of these terms, with notice where that is practical. Sections 8 through 14 survive.

13. Governing law

Georgia law governs these terms, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Georgia, and we each consent to their jurisdiction.
